High Court gives go ahead for 50 new homes near Bishops Cleeve

A 50-home development will go ahead near Bishops Cleeve north of Cheltenham after developer, L&Q Estates, won a two-year High Court battle with Tewkesbury Borough Council.

A development of 50 new homes will be built in a village near Bishops Cleeve, after L&Q Estates won its High Court battle.

Tewkesbury Borough Council had challenged a decision by a government planning inspector to grant outline planning permission for the houses in Gotherington, near Bishops Cleeve, following a public inquiry into the scheme in 2020.

But the High Court has ruled in favour of Warwick-based housing association and developer L&Q Estates and work is expected to start in 2022, once planning details around landscaping and external appearances have been approved.

Richard Edwards, group planning director for L&Q Estates, said: ‘The 50 homes will include 40 per cent affordable housing which means more families from the locality will be able to buy a property in this lovely village since it will double the provision of affordable housing within Gotherington.’

Paul Skelton, Tewkesbury Borough Council’s development manager, said the local authority was ‘disappointed by the judgment’ but ‘looked forward to working with the developers to help deliver a high-quality development on this site’.

The council argued it had already over-delivered on its housing requirement in previous years, but although the judge concluded over supply was an important factor, it was not significant enough to sway the decision.
